Terms of Service

1. Acceptance of Terms

By accessing or using the Who Touch My Phone mobile application ("the App"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the App.

2. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that:

• You are at least 13 years old
• You have the legal capacity to enter into this agreement
• You will use the App only for lawful purposes
• You own the device on which you install the App, or have explicit permission from the device owner

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on mobile devices that you own or control
• Use the App for your personal, non-commercial use
• Use the App in accordance with all applicable laws

4. Prohibited Uses

You agree not to use the App for any of the following purposes:

4.1 Illegal Activities

• Spying on individuals without their knowledge or consent where illegal
• Violating any local, state, national, or international laws
• Stalking, harassment, or invasion of privacy

4.2 Unauthorized Monitoring

• Monitoring devices you do not own without explicit permission
• Installing the App on devices owned by others without consent
• Using the App for commercial surveillance

4.3 Technical Violations

• Reverse engineering, decompiling, or disassembling the App
• Attempting to circumvent security measures
• Modifying, adapting, or creating derivative works

5. Subscription Terms

5.1 Free Trial

We offer a 7-day free trial for new users. After the trial period ends, you will be automatically charged according to your selected subscription plan unless you cancel before the trial ends.

5.2 Subscription Plans

We offer three subscription plans:

• Weekly: ₹199 per week
• Monthly: ₹499 per month (Most Popular)
• Yearly: ₹1999 per year (Best Value)

5.3 Automatic Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Cancellation

You can cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing cycle.

5.5 Refunds

All sales are final. We do not provide refunds for subscription payments except as required by applicable law.

6. User Responsibilities

As a user, you are responsible for:

• Ensuring you have legal authority to monitor the device
• Complying with all applicable privacy laws
• Keeping your account credentials secure
• Using the App in an ethical and responsible manner
• Notifying us of any security breaches or unauthorized access

7. Intellectual Property

The App, including all content, features, and functionality, is owned by Who Touch My Phone and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works
• Use our trademarks or logos without permission
• Remove any proprietary notices
• Transfer any rights to the App

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results from using the App will be accurate or reliable
• Any errors in the App will be corrected

9. Limitation of Liability

In no event shall Who Touch My Phone, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other malicious code
• Any errors or omissions in any content

10. Indemnification

You agree to defend, indemnify, and hold harmless Who Touch My Phone and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, resulting from or arising out of:

• Your use and access of the App
• Your violation of these Terms
• Your violation of any third-party right
• Any claim that your use caused damage to a third party

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the App will cease immediately. If you wish to terminate your account, you may simply discontinue using the App.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
